Etiqa Philippines also offers financial assistance to educators.

The types of personal data we collect may include, but is not limited to your name, address, other contact details, age, occupation, marital status, place of birth, financial references (e.g. income, tax particulars, credit history), information on personal identifiers (e.g. identity card, passport), medical conditions and diagnosis and your transaction history.

If you are supplying personal data of other parties such as your family members, legal guardians, nominees, directors, shareholders of offices, please do ensure that you have obtained their consent and bring this Privacy Notice to their attention.

We obtain your personal data in various ways, such as:

1. When you apply for any of the product/ services which we offer.
2. When you sign up for or use one of the many services we provide or when you register an account at any Etiqa Philippines website.
3. When you contact us through various methods such as application forms, emails, letters, telephone calls, conversations with our staff or branch personnel.
4. If you contact us or we contact you by telephone, we may monitor or record the conversation for quality assurance, training and security purposes.
5. When you participate in customer surveys or sign up for any competitions or promotions.
6. When we obtain data and information from credit reference agencies, regulatory and enforcement agencies and/ or that which is available in the public domain.
7. When you agree to be a third party network provider and/ or any other similar arrangement to facilitate delivery of our product/ services.
8. From your transactions (e.g. payment history, account balances, etc).
9. From video recordings from close circuit security surveillance cameras and audio recordings.
10. From third parties to which you may be affiliated and who purchased our products and/ or contracted our services for your benefit (e.g. employer, professional associations, agent of your employer).
11. Personal data we collect from our websites - IP Address. An IP Address is a number that is automatically assigned to your computer when you signed up with an Internet Service Provider. When you visit our website, your IP Address is automatically logged in our server. We use your IP address to help diagnose problems with our server and to administer our website. From your IP address, we may identify the general geographic area from which you are accessing our website. Generally we do not link your IP address to anything that can enable us to identify you unless it is required by law and regulation. Information on Cookies. A cookie is an element of data that a website can send to your browser, which may then store it on your system. We use cookies in some of our pages to store visitor’s preferences and record session information. The information that we collect is then used to ensure a more personalized service level for our users. You can adjust settings on your browser so that you will be notified when you receive a cookie. Please refer to your browser documentation to check if cookies have been enabled on your computer or to request not to receive cookies.

We use your personal data in various ways, such as:

1. To assess your application for any of our products and services or continue provisioning of the products and/ or services (whichever is applicable).
2. To manage and maintain your account with Etiqa Philippines.
3. To continue performing the contractual obligations entered into between Etiqa Philippines and you.
4. To respond to your inquiries and complaints and to resolve disputes.
5. For internal functions and to support the Maybank Group such as evaluating the effectiveness of marketing, market research, statistical analysis and modelling, reporting, audit and risk management and to prevent fraud from time to time.
6. To provide you with information on products and/ or services of Etiqa Philippines and the Maybank Group.
7. To prevent fraud or detect crime for the purpose of investigation.
8. For security reasons, in particular personal data collected from close circuit security surveillance cameras.
9. For any purpose required by law or regulations (e.g. Anti-Money Laundering Law, Credit Information System Act, Foreign Account Tax Compliance Act). In this regard, your personal data may be furnished the relevant government agency (e.g. Insurance Commission, Credit Information Corporation, Anti-Money Laundering Council).
10. If you are a beneficiary and not a policyholder/ member, we will only process your personal data for purposes relating to administering the insurance policy.
11. From time to time, we may share your personal data with "Other Entities" (e.g. our/ you/ your employer and/ or your employer’s agents/ brokers, strategic partners, network providers and other third parties) as Etiqa Philippines deems fit and in order to better serve your account. You may also receive marketing communication from us about products and services that may be of interest to you. If you no longer wish to receive these marketing communications, please notify us and we will stop processing your personal data for the purpose of sending you marketing communications. If you would like to withdraw consent for marketing and promotional materials, you may contact us using the contact details found below. Please be aware that once we receive confirmation that you wish to withdraw your consent for marketing or promotional materials, it may take up to seven (7) days for your withdrawal to be reflected in our systems. Therefore, you may still receive marketing or promotional materials during this period of time.
12. If you are a beneficiary/ dependent and not a policyholder/ member, we will only process your personal data for purposes relating to administering the insurance policy/ contract.

The security of your personal data is our priority. Etiqa Philippines takes all physical, technical and organizational measures to ensure security and confidentiality of personal data in the collection, use, storage, retention, disposal and disclosure to Other Entities. For personal data that we disclose to Other Entities, we will require them to appropriately safeguard the personal data transmitted to them.

We will only retain your personal data for as long as necessary to fulfill the purposes for which it was collected or to comply with legal, regulatory and internal requirements.

As data subjects, you are entitled to the following rights under existing data privacy laws, rules and regulations:

1. Rights to be Informed. Be informed on whether your personal information shall be, are being or have been processed.
2. Be furnished with the information indicated below before the entry of your personal information into our processing system or at the next practical opportunity:
   • Description of the personal information to be entered into the system.
   • Purposes for which they are being or are to be processed.
   • Scope and method of the personal information processing.
   • The recipients or classes of recipients to whom they are or may be disclosed.
   • Methods utilized for automated process, which you, as a data subject has allowed, and the extent to which such access is authorized.
   • The identity and contact details of our representative duly designated to attend to your concerns on data privacy.
   • The period for which the information will be stored.
3. Right to File a Complaint. The existence of your rights (e.g. access, correction) as well as the right to lodge a complaint before the relevant government agency.
4. Any information supplied or declaration made to you on these matters shall not be amended without prior notification: Provided, that the notification under subsection (b) shall not apply should the personal information be needed pursuant to a subpoena or when the collection and processing are for obvious purposes, including when it is necessary for the performance of or in relation to a contract or service or when necessary or desirable in the context of an employer-employee relationship, or when the information is being collected or processed as a result of a legal obligation.
5. Right to Access. Reasonable access to, upon demand, the following:
   • Contents of your personal information that were processed.
   • Sources from which personal information were obtained.
   • Names and addressed of recipients of the personal information.
   • Manner by which such data was processed.
   • Reasons for the disclosure of the personal information of recipients.
   • Information on automated processes where the data will or likely be made as the sole basis for any decision significantly affecting or will affect you.
   • Date when your personal information was last accessed and modified.
   • The designation, name or identity of our Personal Information Controller.
6. Right to Rectification. Dispute the inaccuracy or error in the personal information and have us correct it immediately and accordingly, unless the request is vexatious or otherwise unreasonable. If the personal information has been corrected, we shall ensure accessibility of both the new and the retracted information by recipients thereof; provided, that the third parties who have previously received such processed personal information shall informed of its inaccurary and its rectification upon your request.
7. Right to Object. Object to the processing of your personal data, including processing for direct marketing, automated processing or profiling. You likewise have the right to be notified and be given an opportunity to withhold consent to the processing in case of changes to the information given to you regarding processing your information.
8. Right to Erasure. Suspend, withdraw or order the blocking, removal or destruction of your personal information from our filing system upon discovery and substantial proof the personal information are incomplete, outdated, false, unlawfully obtained, used for unauthorized purposes or are no longer necessary for the purposes for which they were collected.
9. Right to Damages. Be indemnified for any damages sustained due to such inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of personal information.
10. Right to Data Portability. Where personal information is processed by electronic means and in a structured and commonly used format, you have the right to obtain from us a copy of data undergoing processing in an electronic and structured format, which is commonly used and allows for further use.

1. Definition of Terms


As used herein, unless otherwise specified:

1. Plan Member/s shall mean any of the following:
2. The eligible Principal Enrollee enrolled by the Plan Holder and/or
3. The respective eligible enrolled dependents of Principal Enrollees who are, at the time of registration to use the Smile PH App, are of legal age.
4. Plan Holder shall mean the legal entity to which the Plan Members are
5. Etiqa shall mean Etiqa Life and General Assurance Philippines
6. Accredited Provider/s refers to either the hospitals and/or clinics and/or physicians nationwide accredited to Etiqa
7. Accredited Dentist/s” and/or “Accredited Dental Clinic/s refer to the respective dentist/s and/or dental clinic/s that are accredited to Etiqa’s outsourced dental network provider/s
8. Dental Network Provider/s refer to Etiqa’s outsourced provider from where Plan Members can avail, if any, their respective dental benefits
9. Mobile device shall refer to any electronic device such as, but not, at the moment, limited to, smartphones used by the Plan Member in downloading the Smile PH App, in registering to use the Smile PH App and using the Smile PH App
10. use of the Smile PH App shall refer to the use of any or all the current and/or succeeding functions and/or features of the Smile PH App
11. Schedule of Benefits refers to and is limited to the Plan Member’s own benefits
12. Program refers to any or all of the in-force Group Insurance and/or Individual Insurance to where the Plan Member is currently enrolled eligibly.
2. Grant of License and Applicability of Smile PH App Terms and Conditions



Being a Plan Member enrolled on an in-force Program by the Plan Holder, the Plan Member acknowledges that the Plan Member is granted with non-transferable, personal and limited privilege to install and use the Smile PH App on a Mobile Device that the Plan Member owns and/or has sole control of use and/or access on.

The Smile PH App Terms and Conditions shall be in addition to the Data Privacy the Plan Member also signifies acknowledgement, understanding and acceptance of.

3. General Rules



The Plan Member hereby agrees to be bound by, understands, accepts and agrees to the following general rules governing the use of the Smile PH App:

1. the Plan Member will be able to download the Smile PH App even if the Plan Member is not enrolled yet or even as the Plan Member’s enrollment is not yet completely processed
2. in order to register and/or use the Smile PH App, the Plan Member must:
1. be enrolled
2. has the Plan Member ID number
3. use the complete name and birth date that the Plan Holder sent to Etiqa when the Plan Member was enrolled
3. Only Plan Members whose respective enrollment is completely processed can gain access to and usage of the Smile PH App.
4. As an individual registers to access and use the Smile PH App, the individual attests that the said individual is the same and actual Plan Member who is enrolled in the Program. The Plan Member shall not hold Etiqa responsible for anyone acting as Plan Member to download and/or access and/or use the Smile PH App.
5. The Plan Member confirms that the Plan Member has the responsibility for the security of registration and the succeeding use of the Smile PH App.
6. The Plan Member confirms that the Plan Member, at the onset of the registration on the use of the Smile PH App, is the same person registering as the Plan Member.
7. The Plan Member also confirms that all inquiries will only be related to the Plan Member’s own Schedule of Benefits and/or Limitations of the Program and/or enrolled eligible dependents (if any), etc. Any reply to an inquiry that is not particular to the Plan Member does not constitute confirmation from Etiqa as applicable to the Plan Member.
8. Etiqa may, at any time and sole volition and without notice to the Plan Member and/or Plan Holder, suspend the downloading of the Smile PH App and/or registration and/or access and/or use for reason Etiqa deems necessary. And, any and/or all features and/or functions of the Smile PH App may, at any time, be changed and/or enhanced without prior notice.
9. To enable Etiqa to aptly attend to matters related to the delivery of service (such as, but not limited to, availments and/or claims and/or enrollment and/or inquiries and/or other matters that are brought to Etiqa’s attention) and/or any needs of the Plan Member, the Plan Member gives Etiqa a continuing authority to send the Plan Member information and/or messages through texts and/or e-mail and/or any other means of communication directly and/or through the authorized representatives (generally referring to, for Plan Members of a corporate account, Plan Holder’s authorized Human Resource persons who transact with any of the Etiqa employees).
10. Many of our services require us to collect images and other information from your device's camera and photos. For example, you won't be able to send Snaps or upload photos from your camera roll unless we can access your camera or photos.
11. You will need to have 'location services' enabled on your device to be able to use many of the App's features. While 'location services' remain enabled, the App will also collect and use data about your location in order to provide you with more relevant and personalized information. You may turn this feature off in your device's 'settings', however if you do so some of the App's functionality and features will no longer be available to you. Please see our Privacy Policy for more information on how we collect and use data about your location.
4. Lost Mobile Device



In the event the Plan Member loses the Mobile Device used in accessing the Smile PH App, it is the Plan Member’s sole responsibility to reset the password using another (or, new) Mobile Device.

5. Disclaimer
1. Etiqa is unable to receive or execute any of the requests from the Plan Member due to reasons beyond the control of Etiqa such as, but not limited to, services that should be rendered by Etiqa’s accredited provider/s.
2. Possible loss of information during processing or transmission or any unauthorized access by any other person due to reasons beyond the control of Etiqa;
3. Any loss, cost, or damages as a result of, or caused by any delay in the delivery of service beyond the control of Etiqa;
6. Other Provisions



The exact provisions of the master policy that is in-force shall serve as the sole reference in addressing any matter related to the Plan Member’s Schedule of Benefits, Limitation of the Plans, etc.

The Smile PH App does not, in any way, replaces any master policy provision.
